These Terms & Conditions ("Terms") govern your access to and use of the Book Every Job website and services. Book Every Job is a product of Digital One LLC ("Book Every Job," "we," "us," or "our").

By accessing the website, requesting a demo, creating an account, purchasing services, or otherwise using Book Every Job, you agree to these Terms. If you do not agree, do not use the website or services.

1. Definitions

"Website" means the Book Every Job website and related pages.

"Service" means the Book Every Job platform, features, workflows, integrations, messaging, scheduling, support, and related offerings.

"Customer" means any business or person that purchases, accesses, or uses the Service.

"End User" means a caller, lead, homeowner, or other person with whom a Customer communicates through the Service.

2. Eligibility and Business Use

You may use the Website and Service only if you are legally able to enter into a binding agreement and your use complies with applicable law.

The Service is intended primarily for business use. If you use the Service on behalf of a business or organization, you represent that you have authority to bind that business or organization to these Terms.

3. What Book Every Job Does

Book Every Job helps businesses respond to missed calls using automated text-based workflows and related scheduling, communication, and lead-management features.

Features may include missed-call detection, text follow-up, contact capture, scheduling workflows, calendar integration, message history, support tools, and related functions. Specific features may vary by plan, setup, availability, integration, and service configuration.

We may add, remove, improve, or modify features from time to time.

4. No Emergency Use

Book Every Job is not an emergency service.

You may not rely on the Website or Service for emergency communications, life-safety matters, medical emergencies, public safety incidents, or any situation where delay, failure, or inaccuracy could cause injury or harm. End users needing emergency help should call 911 or the appropriate emergency provider.

5. Account and Configuration Responsibilities

If you create an account or use the Service, you are responsible for:

  • Providing accurate and complete information

  • Keeping login credentials secure

  • Restricting unauthorized account access

  • Maintaining current scheduling availability and calendar settings

  • Reviewing your workflows, messages, and business rules for accuracy

  • Ensuring your forwarding, phone, calendar, and connected systems are configured correctly

  • Promptly notifying us of suspected unauthorized access or security issues

You are responsible for all activity that occurs under your account or through your configuration, unless caused solely by our misconduct.

6. Customer Compliance Responsibilities

You are solely responsible for your business practices and legal compliance in connection with your use of the Service, including:

  • Consumer protection compliance

  • Telemarketing and text messaging compliance

  • Privacy and data protection compliance

  • Required notices, disclosures, and consents

  • Your own website terms and privacy policy

  • The content and timing of communications sent on your behalf

  • The legality of the phone numbers, contacts, and data you use with the Service

You represent and warrant that you have all rights, permissions, and lawful bases needed for Book Every Job to process and use data, send communications, and perform services on your behalf.

7. Consent to Communications

By submitting a form, requesting a demo, creating an account, or providing your contact information, you agree that Book Every Job may contact you by email, phone, or text about your inquiry, onboarding, account, support, and where permitted, promotions or updates.

Message frequency may vary. Message and data rates may apply. Reply STOP to opt out of marketing texts. Reply HELP for assistance.

8. End-User and Message Content

You retain responsibility for the business communications sent or triggered on your behalf through the Service.

You may not use the Service to send or facilitate unlawful, misleading, harassing, abusive, discriminatory, infringing, or spam communications.

We may suspend, block, remove, or review content or usage that we reasonably believe violates these Terms, creates legal risk, threatens security, harms our systems, or exposes us or others to liability.

9. Third-Party Services and Integrations

The Service may depend on or integrate with third-party providers, including phone, messaging, hosting, payment, calendar, CRM, analytics, or software platforms.

We are not responsible for third-party systems, availability, outages, policy changes, data handling, pricing, or performance. Your use of third-party tools may also be subject to separate terms and privacy policies from those providers.

10. Fees, Billing, and Payment

Fees, setup charges, subscription charges, usage charges, and payment terms will be as stated in the applicable order form, checkout page, proposal, invoice, or written agreement.

Unless otherwise stated in writing:

  • Fees are due in advance for subscription periods

  • Usage-based charges, if any, may be billed in arrears

  • Payments are non-refundable once paid

  • We may suspend or terminate Service for overdue amounts

  • You are responsible for applicable taxes, except taxes on our net income

If pricing changes, the updated pricing will apply at the next renewal or as otherwise stated.

11. Term and Termination

These Terms remain in effect while you use the Website or Service.

You may stop using the Service at any time, subject to any active billing commitments or written agreements.

We may suspend or terminate your access immediately or at any time if:

  • You violate these Terms

  • Your use creates legal, security, reputational, or operational risk

  • Payment is overdue

  • A third-party provider requires suspension

  • We discontinue the Service or a relevant feature

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, limitation of liability, indemnification, intellectual property, and dispute provisions.

12. Intellectual Property

The Website and Service, including software, branding, content, workflows, design, graphics, interfaces, and related materials, are owned by Book Every Job, Digital One LLC, or their licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes.

You may not:

  • Copy, reproduce, modify, distribute, sell, sublicense, or create derivative works from the Service

  • Reverse engineer or attempt to extract source code, except where prohibited by law

  • Remove proprietary notices

  • Use our trademarks without written permission

13. Feedback

If you send us suggestions, ideas, or feedback, you grant us the right to use them without restriction or compensation to you.

14. Disclaimers

THE WEBSITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOK EVERY JOB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or available at all times

  • All leads, calls, texts, or bookings will be captured successfully

  • The Service will produce any specific revenue, conversion, or business result

  • Any integration, carrier, or third-party dependency will function without interruption

  • The Service will meet every legal requirement applicable to your business without your own review and configuration

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOK EVERY JOB, DIGITAL ONE LLC, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Book Every Job, Digital One LLC, and their owners, officers, employees, contractors, affiliates, and licensors from and against any claims, losses, liabilities, damages, judgments, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Website or Service

  • Your violation of these Terms

  • Your violation of applicable law

  • Your communications with end users

  • Your data, content, phone numbers, or business practices

  • Your infringement or alleged infringement of any third-party rights

17. Privacy

Your use of the Website and Service is also subject to our Privacy Policy.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms, the Website, or the Service shall be brought exclusively in the state or federal courts located in Monmouth County, New Jersey, and you consent to the jurisdiction of those courts.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the Effective Date. Your continued use of the Website or Service after the updated Terms are posted means you accept the revised Terms.
